1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of the website callsforlife.com and the related services operated by Calls For Life, a DBA of Virtual Marketing, LLC ("Calls For Life," "we," "us," or "our"), through which licensed insurance agents may purchase and receive inbound phone calls and book introductory calls (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility

The Services are intended solely for licensed insurance professionals who are at least 18 years of age. By using the Services, you represent that you hold, and will maintain, all licenses and appointments required to sell the insurance products for which you receive calls, in every state where you receive them.

3. The Services

Calls For Life routes inbound, consumer-initiated phone calls to participating agents. Call availability, volume, verticals, languages, and pricing vary and are not guaranteed. We may add, modify, pause, or discontinue campaigns, verticals, features, or the Services at any time.

4. Accounts, Prepaid Balance, and Billing

  • Access to calls requires a funded, prepaid account balance. Amounts you load are drawn down as billable calls are delivered.
  • A call becomes billable when it remains connected for at least ten (10) seconds ("the buffer"), unless different terms are stated for a specific campaign in writing.
  • Per-call pricing varies by vertical, language, and volume and will be communicated to you before you fund your account or when pricing changes.
  • You may pause call flow or stop funding at any time. There are no long-term contracts, subscriptions, or cancellation fees.

5. Call Review and Credits

You may request review of any billed call. Our team will review requested calls and determine, in our reasonable discretion, whether a credit is due (for example, dead air, wrong numbers, or duplicates). Approved credits are applied to your account balance and are not issued as cash refunds. Prepaid balances are otherwise non-refundable except where required by law or expressly agreed in writing.

6. No Guarantee of Results

We do not guarantee that any call will result in a quote, application, sale, or commission. Conversion depends on factors outside our control, including your availability, sales practices, licensing, product offering, and carrier relationships. Any statistics, comparisons, or examples on the Services are illustrative and not a promise of performance.

7. Your Responsibilities

  • You are solely responsible for your conduct on calls and for complying with all laws, regulations, and carrier and regulator requirements applicable to your sales activity, including insurance licensing, marketing, and (where applicable) CMS Medicare marketing rules.
  • You will not record, resell, transfer, or share calls or caller information except as permitted by law and, where applicable, by the caller.
  • You will keep your account information accurate and safeguard your login and routing details.

8. Acceptable Use

You agree not to misuse the Services, including by: interfering with their operation; attempting to access accounts or data that are not yours; using the Services for any unlawful, deceptive, or abusive purpose; harassing callers; or misrepresenting your identity, licensure, or affiliation.

9. Communications

By submitting your contact information through the Services, you consent to receive calls, emails, and SMS messages from Calls For Life regarding pricing, bookings, and your account, as described in our Privacy Policy. Consent is not a condition of purchase. Reply STOP to opt out of SMS at any time.

10. Intellectual Property

The Services, including all content, branding, design, and software, are owned by Virtual Marketing, LLC or its licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Services for their intended purpose. No other rights are granted.

11. Third-Party Services

The Services rely on third-party providers (for example, hosting, scheduling, messaging, and analytics). We are not responsible for third-party services, and your use of them may be subject to their own terms.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CALL VOLUME WILL MEET YOUR EXPECTATIONS.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CALLS FOR LIFE AND VIRTUAL MARKETING, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Calls For Life, Virtual Marketing, LLC, and their officers, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your sales activity, or your violation of these Terms or applicable law.

15. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or to protect the Services, callers, or other users. Upon termination, any unused prepaid balance will be handled in accordance with Section 5 and applicable law. Sections that by their nature should survive termination will survive.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date reflects the latest revision. Continued use of the Services after changes constitutes acceptance of the updated Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.
